CALIFORNIA SEXUAL HARASSMENT GUIDELINES FOR 2020


STATE OF CA GUIDELINES

Any business that has at least 5 employees, must have all Supervisors and Employees trained before 1/1/2021.

The training must be completed every two years for supervisors and every year for all regular employees.

Employer must keep records the training was completed. Good examples of records are: Sign up sheet with all employees’ names that attended; Certificates of Completion with all employees’ names, among other important documents. *

Employers/Business must have a Sexual Harassment (Promoting a Respectful Workplace) Policy in place and a copy of it must be provided to all employees when hired.

If Business does not have one, I can provide you with some samples or copy of one you could adopt and it is approved by State of CA.

New hires must be trained as part of their Orientation by an approved Trainer. Newly promoted Supervisors must be trained within six months of promotion.
PREVENTION
A program to eliminate sexual harassment from the workplace is not only required by the law, but it is the most practical way for an employer to avoid or limit liability if harassment occurs.

Distribute copies of the brochure from Department of Fair Employment and Housing (Sexual Harassment). Attachment included.

Post a copy of the Department’s Employment Poster entitled “California Law Prohibits Workplace Discrimination and Harassment”.

Transgender Rights and New Parent Leave Act posters MUST BE ON DISPLAY NOW.

Develop a Harassment, Discrimination, and Retaliation prevention policy in accordance with 2 CCR 11023. This flyer provides all of the details what the policy must contain.
TRAINING

Depending of the size of the organization, optimal is to train 25 persons (employees) per 1-hour requirement per session. More people can be trained but, it will be up to the organization.

Supervisors require a two-hour training. The number can vary by the needs of the organization.

At the end of the training, the organization will receive all of the Certificates signed by their employees, a copy of the Sign-Up Sheet along with a copy of the brochure from the Department of Fair Employment and Housing (Sexual Harassment).
